Decertification Information for Employees

Your choice, your voice: Decertification is how employees decide for themselves whether to keep or remove the union as their representative.

How it works: At least 30% of employees must sign a petition to request an NLRB election. If 50% or more of those who vote choose decertification, the union is removed.

After decertification: Employees regain the ability to deal directly with management without having to pay union dues or fees.

Privacy guaranteed: The election is conducted by secret ballot, so no one will know how you voted.

Protection from retaliation: Federal law makes it illegal for either the union or the employer to threaten, coerce, or retaliate against you for your vote.

Fair election safeguards: The NLRB oversees the process to ensure it is fair, lawful, and fully protects employee choice.

Union tactics: As you may have already seen, unions like to delay or block the votes through legal filings or pressure campaigns, but these cannot stop the process if employees remain committed.

Stay informed and empowered: Knowing your rights and the process helps protect your ability to make the choice that’s best for you and your
coworkers.

Unity matters: Remaining unified and persistent strengthens employees’ chances of success and ensures that every voice is heard.
